These terms and conditions constitute the entire agreement between Christian
Alexander Recruitment Linited (CAR) and the employer client ('the client')
and shall be shall be deemed to be accepted by and binding on the Client upon
any candidate
introduced by CAR ('the Candidate') being interviewed by the client upon engagement
of the Candidate by the Client or any asociated company of the client in any
capacity at any time and whether under a contract or for services (which term
also
includes the Candidate being retained by the Client in a personal or corporate
capacity or as Agent or distributor for the Client) ('Engagement')The Candiadate
shall be deemed to be introduced by CAR regardless of whether previously interviewed
by or otherwise known by the Client
The fee payable by the Client tp CAR is for the introduction and engagement
or the Cnadidate. For the avoidance of doubt the word 'introduction' means
the presentation of the Candidate BT CAR to the Client for engagement, whether
or not the Client
know of such applicant previously. The fee is payable immediately the Candidate
is Engaged by the Client whether immediately
or at a later date.
The indroduction fee payable by the CLient for the introduction of the Candidate resulting in an Engagement is in accordance
with the scale detailed below. Salary is deemed to include the annual basic salary or wage or retainer paid, plus any
allowances and guarantees for the entire 12 month period pro rata. Such fee shall be subject to the addition of Value Added Tax.
Nothwithstanding the above the minimum fee in respect of all placements will be £1750.00 plus VAT.
Where the Candidate is self-employed or otherwise employed under a contract
for services the fee will not be less than
£1500.00 plus VAT. In such circumstances where the Candidate is guaranteed
a gross salary (whether it be in the form of wages
or commission) the fee payable to CAR will be calculated in accordance with the
scale below.
Fees will be payable as a result of the Engagement notwithstanding the fact that it maynot comply with the Client's original
requirements (eg. as to number or type of vacancies) on the following basis.

3 PAYMENT
The fee becomes payable immediatley upon Engagement regardless of when the
Candidate commences work in whatever capacity the Candidate is engaged by the
Client.
Interest shall be payable by the Client to CAR on the fees which have not
been paid within 14 working days of invoices being rendered at the rate of
3% per annum
above the base rate of the Royal Bank of Scotland plc accruing from day to day
from the date such invoice is rendered until payment in full is received.
The introduction of the Candidate is confidential. To pass such
introduction or any information concerning the Candidate to any other party
renders
the Client liable to the fees set out in clause 3 where the passing of such introduction
or information leads to an engagement of the Candidate in any capacity and
whether
under a contract of or for other services (which term also includes the Candidate
being retained by the Client in a personal or corporate capacity or as Agent
or
Distributor for the Client)
CAR does not recognise trial periods for Candidates. In the event
of the Candidate leaving the Client's service ('the Termination') following the
commencement of work for the Clinet rebates shall be payable in such proportion
and for such period as are proviced below, providing such fee was paid in accordance
with the time specified invoice. Should the CLient or any associated company re-emgage
the Cnadidate within six months of the termination the full fee becomes payable
less credit for any amounts already paid to CAR in respect of the Engagement.
No rebate will be made or permitted unless the Client notifies CAR in writing
within 7 days of the termination.
Although every reasonable effort is made to ensure the suitability
of each Candidate CAR does not personally establish references and the Client
is responsible for taking up references, checking qualifications, including driving
licenses, work permits, arranging medical examinations and the like.
Subject to the terms of the Unfair Contract Terms Act 1977 CAR cannot accept
responsibility for any statement or representation about a Candidate made by its
servants or agents, whether or not in writing, nor can it accept responsibility
for any loss, expense or damage incurred directly or indirectly by the Client
in respect of any Candidate.
CAR can accept no liability of any kind for any loss or damage to property
or for any other loss including without prejudice the the generality of the foregoing
loss of profit or for any injury to person arising directly or indirectly from
any act or omission by CAR even if such act or mission is negligent, fraudulent
or dishonest.
The agreement shall not be varied in any way except in writing
by a Proprietor of CAR.
